| 1. What is the Trademark Gallery ® and how does it work ? |
LAGO puts registered trademark sellers in contact with potential buyers on its web site www.lagaleriedesmarques.com and helps to facilitate the negotiation of a sale.
The operation is simple.
Sellers and their Counsels (Lawyers, Industrial Property Advisers etc.) tell LAGO which trademarks they want to sell and set the terms, they may also set a sale price.
They sign an exclusive contract with LAGO while the trademark is for sale by LAGO. Potential buyers search for the trademark that interests them on the site and
can make a purchase offer via LAGO.
| 2. Is it expensive to search for brand names that are available to buy? |
| No, it is free of charge.
Potential buyers or their Counsel simply register on the site and then have free access to the Trademark Gallery to look at trademarks for sale and make purchase offers
via LAGO who will convey them to the sellers.
| 3. Who is this site for? |
| This site is for trademark professionals.
Trademark regulations are complex.
If you are not a specialist we advise you to consult Counsel such as a Lawyer or Industrial Property Adviser.
LAGO does not provide legal advice. LAGO does however give advice about trademark values. |
| 4. How is a sale price set ? |
Some sellers will indicate a minimum price or desired price range, others will not.
There is no set sale price range to speak of. Prices depend on several factors such as: time left until the trademark expires, registration name, number of countries covered, the trademark?s reputation,
and existence or not of a logo or associated domain name and of course the seductive power of the trademark.
LAGO can advise you. In general the purchase price is less than the cost of creating a name.
The success of the final negotiation often depends on a compromise between the price desired by the seller and the amount the buyer is willing to pay. |
| 5. How can a buyer make a purchase offer? |
If interested, buyers or their Counsel ask LAGO who has an exclusivity contract with the sellers to make an offer to the buyer.
LAGO cannot negotiate for the seller who alone decides on the final sales terms but LAGO does convey the proposals and counter-proposals for the parties.
LAGO uses its trademark value experience to facilit ate the determination of the best price for both parties.
The buyer may ask LAGO to convey its offer anonymously and LAGO will, in this first step, guarantee the buyer?s anonymity thus preserving the buyer?s interests.
| 6. What happens if the offer is accepted? |
| The trademark sale is concluded.
The parties regularise their agreement. It is important at this stage to call upon a trademark law professional.
| 7. How does LAGO get paid? |
| LAGO gets paid by the buyer on the day the sale is made; the fee is a percentage of the sale price. |
| 8. Which trademarks are for sale? |
| French trademarks, international trademarks destined for the French market, EU trademarks and foreign trademarks.
They are all registered. In general they are not being used or no longer being used.
Some are used but the trademark?s use is not a major factor in the sale price. |
| 9. Are domain names for sale? |
| More and more domain names are associated with trademarks including major extensions like .com, .fr as well as .tm, .fr, .info, .biz, .org etc.
A domain name associated with a trademark increases the value of the domain name.
| 10. What are the trademark search criteria on the site? |
| By registration class, galleries and by words listed in product or service names covered by the trademark. |
| 11. How is the "LAGO recommendation" drafted? |
The LAGO recommendation found at the end of the trademark presentation is exclusively drafted by trademark and name creation professionals
and reflects their opinions regarding qualities such as: trademark structure, euphony, evocation power etc.
