- LAGO pledges to respect ethical rules and confidentiality.
All negotiations are carried out by LAGO for confidentiality reasons.
LAGO especially pledges to keep all discussions between parties strictly confidential and not divulge information given to LAGO by one party to another unless formal approval is given by this party to divulge certain information to the other party.
- The Trademark Gallery® is only an online media allowing sellers and buyers of registered trademarks to contact one another.
LAGO may transmit sale or purchase offers but does not represent the seller or the buyer who remain the sole judges of the opportunity for negotiating or realising any sale.
- The seller pledges to not itself undertake the sale of nor present its trademarks for sale other than via LAGO during its mission to find buyers.
- The seller pledges to communicate all sincere and reliable information concerning its trademarks.
To its knowledge they do not infringe upon any law or regulation, nor infringe on the rights of third parties and more specifically on the rights of trademarks or other third party intellectual property rights.
LAGO will do everything possible to gather the necessary information on trademarks that are for sale but will in no case whatsoever be held responsible for the content of the information that is distributed on its site or the capacity of sellers to sell their registered trademarks or the proper outcome of any transaction.
- Users may not hold LAGO responsible in the event of a dispute between them.
They bear full responsibility for their contributions to the site.They pledge to guarantee LAGO against any claims from third parties caused by their not respecting their portion of these terms or a violation on their part of French or European law or any third party law, especially in the event of counterfeiting action.
- LAGO is in no position to formally confirm the identity of users.
It is the users' responsibility to be especially careful.
Unfortunately LAGO may not guarantee that there will be no total interruptions or partial momentary ones of the services that are proposed on its site but will do everything possible in conjunction with its IT partner to prevent or minimise them.
- As trademark law is complex, we recommend to users, if they are not specialists, to avail themselves of assistance by an intellectual property law professional (lawyer specialised in intellectual property, industrial property consultant, specialised jurist).
We warn you with regard to your using our services which may result in you being qualified as a ?commercant? as defined in article L2121-1 of the Commercial Code. - In the event of a dispute between the parties, they pledge to make every effort to in good faith seek an amicable solution for their dispute and if necessary do so under the guidance of the Centre de Mediation et d?Arbitrage de Paris de la Chambre de Commerce et d?Industrie de Paris in compliance with the mediation regulation of said C.M.A.P. to which the parties declare they adhere.
In the event that two months after a mediator has been nominated by C.M.A.P. and despite their efforts, the parties have yet to find an agreement; competence will be granted to the competent judiciary courts, according to French law in order to settle their dispute.
